Borders, customs and immigration in Poland

One uniformed, armed formation guards the state border on land and at sea under the interior minister, and its commanders also decide returns; customs belong to a fiscal administration under the finance minister; residence is decided by voivodes, and protection by a central office.

Poland has a body constituted for the border, and its statute says what kind. Article 1 of the Border Guard Act makes the Straż Graniczna a "jednolitą, umundurowaną i uzbrojoną formacją przeznaczoną do ochrony granicy państwowej" — a single, uniformed and armed formation for protecting the state border, controlling border traffic and preventing illegal migration. Under article 3 its Commander-in-Chief "jest centralnym organem administracji rządowej podległym ministrowi właściwemu do spraw wewnętrznych": a central organ of government administration, subordinate to the minister for internal affairs.

The same formation holds the land, the sea and the crossings. The Act’s list of tasks opens with protecting the state border "na lądzie i morzu" — on land and at sea — and with organising and carrying out border-traffic control, and it includes supervising the use of Polish sea areas and ships’ compliance with the rules that apply in them. The Border Guard’s own plain-language page says that its posts serve at the crossings and patrol the border line, and that its Maritime Unit has two squadrons of vessels that patrol the Polish sea. It also says which borders are which: those with states in the Schengen area are internal borders, and "Pozostałe 1640 kilometrów to tak zwane granice zewnętrzne" — the remaining 1,640 kilometres are external.

Goods are administered by a different body under a different minister. The Act on the Krajowa Administracja Skarbowa (KAS), Poland’s tax and customs administration, creates within it a Customs and Fiscal Service, "jednolitą i umundurowaną formacją", gives the administration the carrying out of customs policy that follows from Poland’s membership of the Union customs union, and makes its Head subordinate to the minister for public finance. The administration’s own page says its officers work in offices, at the state border, and in sea and air ports. The two meet at one point the statutes name: the Border Guard Act includes detecting certain fiscal offences among the border formation’s tasks.

Who may stay is decided elsewhere, and at two levels. Under the Act on Foreigners, a temporary residence permit is granted or refused by decision of the voivode competent for the place where the foreigner stays. The Head of the Office for Foreigners is the central government body for the entry, transit, stay and exit of foreigners and for refugee status, and is supervised by the minister for internal affairs. The Office’s own page says the Head hears appeals against voivodes’ residence decisions and handles international protection, asylum and temporary protection.

The border formation does have a part in that second question. The same Act provides that a decision obliging a foreigner to return is issued, on the authority’s own initiative, by "komendant oddziału Straży Granicznej lub komendant placówki Straży Granicznej" — the commander of a Border Guard regional unit or post. So in Poland the body that guards the border is also a body that decides a return. What follows from such a decision, and how it is carried out, is not described here.

Veterinary checks at the border belong to an inspection under a third ministry. The Veterinary Inspection Act makes the border veterinary officer the authority competent for official controls of animals and goods at a border control post, places the border control posts within the border veterinary inspectorate, and makes the Chief Veterinary Officer subordinate to the minister for agriculture. Plant-health and sanitary checks at the border were not researched.

The Union layer is written into the Polish statutes themselves. The Border Guard Act provides that "Straż Graniczna realizuje zadania wynikające z przepisów prawa Unii Europejskiej", and the Act on Foreigners refers to Regulation (EU) 2016/399 as the "kodeksem granicznym Schengen" — the Schengen Borders Code.
