Prosecution in Brazil belongs to the Ministério Público. Article 127 defines it as "instituição permanente, essencial à função jurisdicional do Estado", charged with defending "a ordem jurídica, o regime democrático e os interesses sociais e individuais indisponíveis". Its institutional principles are unity, indivisibility and functional independence, and it is guaranteed functional and administrative autonomy.

Two great branches (Article 128)
The Ministério Público da União (MPU) comprises four ramos: the Ministério Público Federal (MPF), the Ministério Público do Trabalho (MPT), the Ministério Público Militar (MPM) and the Ministério Público do Distrito Federal e Territórios (MPDFT). Alongside it stand the Ministérios Públicos dos Estados — one for each state. The MPU has functional, administrative and financial autonomy, in its own words.
What it prosecutes
On the criminal side, the Ministério Público is the exclusive holder of the public criminal action: it decides whether to bring a charge (the denúncia) once the police investigation reaches it. It is not the police, and the charging decision is not the investigator's.
Oversight — the CNMP
The Conselho Nacional do Ministério Público (Article 130-A), created in 2004, is the external body that oversees the Ministério Público — its administrative and financial conduct and the discipline of its members — chaired by the Procurador-Geral da República. It controls the institution without being part of it.
