Borders, customs and immigration in Belgium
Belgium has no border agency: border control is a mission of the federal level of its single integrated police, which also holds the sea. Customs is an administration of the finance ministry; refusal of entry, residence and removal are decided for the interior minister, refugee status by a commissioner general, and animal and food controls at the border by the food-safety agency.

Belgium does not have a border agency. Its police is one integrated service on two levels — "Les services de police sont organisés et structurés à deux niveaux : le niveau fédéral et le niveau local, lesquels assurent ensemble la fonction de police intégrée." — and border control is a mission of the federal level. The royal decree of 14 November 2006 gives the federal police's directorate-general of administrative police "les missions de police administrative spécialisées et l'appui à ces missions en matière de contrôle aux frontières", alongside traffic, railway, navigation and aviation policing. For those administrative-police missions, "la police fédérale est placée sous l'autorité du ministre de l'Intérieur".
The same police holds the sea. The Police Function Act provides that "(La police fédérale) est chargée d'exercer les missions de police maritime et de police de la navigation", and the 2006 decree constitutes a navigation police "qui se compose de services centraux et déconcentrés". At sea, the federal police's administrative-police missions run "dans la mer territoriale belge, la zone économique exclusive et sur le plateau continental, sous l'autorité du gouverneur de la province de Flandre occidentale" — under the governor of a province rather than a minister.
Goods belong to an administration of the finance ministry. The General Law on Customs and Excise defines "administration ou douane" as the Administration générale des douanes et accises, or the Federal Public Service Finances "auquel elle appartient". The administration describes its own missions as financing the Union and Belgium "en percevant les droits d'accise, les droits de douane et la T.V.A. (à l'importation)", and protecting them from unfair and illegal trade.
Who may enter and stay is decided for the interior ministry. Under the Act of 15 December 1980, a refusal of entry is a decision of the minister or a delegate — "La décision est prise par le ministre ou, sauf dans le cas visé à l'alinéa 1er, 6°, par son délégué." — and an order to leave the territory is given the same way; refugee status is for the Commissioner General for Refugees and Stateless Persons. The Immigration Office describes itself as "the largest directorate-general within the Federal Public Service Home Affairs", says "the IO is responsible for the application of the Law of 15 December 1980", and that "It combats illegal immigration and ensures the return or forced removal of illegal residents".
The border keeps a part of that decision, and the statute names it by function rather than by body: "Les autorités chargées du contrôle aux frontières peuvent prendre la décision elles-mêmes dans les cas visés à l'alinéa 1er, 1° ou 2°" — the border-control authorities may refuse entry themselves in two of the cases the article lists. The Police Function Act, separately, charges the police services with enforcing the rules on the entry, stay, establishment and removal of foreigners.
Animal and food controls at the border belong to the food-safety agency, which says so of itself: regulated animals and goods entering the Union "doivent obligatoirement être soumis à des contrôles officiels dans un poste de contrôle frontalier (PCF)", and "En Belgique, l’autorité compétente est l’AFSCA."
The Union layer is written into the Belgian statute and into the Immigration Office’s own account. The 1980 Act refers to the "Code frontières Schengen", and the Office gives the legal basis of a refusal of entry as "Article 14 of the Schengen Borders Code" together with "Chapter II of the Belgian Immigration law of 15.12.1980".
