What it is
Section 16(1) of the Policing Act 2008 makes the Commissioner responsible to the Minister for the functions, general conduct and management of the Police and for giving effect to lawful ministerial directions. Section 16(2) then requires the Commissioner to "act independently of" any Minister on the maintenance of order, the enforcement of the law, "the investigation and prosecution of offences", and decisions about individual employees. That express statutory split is one of the clearest statements of operational independence in this registry.
